This Acceptable Use Policy ("AUP") governs your use of the Services provided by Blueberry Hosting (referred to as "we," "us," or "Blueberry Hosting") and is incorporated by reference into Blueberry Hosting’s Terms of Service. Blueberry Hosting may modify this AUP at any time without notice.
The Services provided by Blueberry Hosting may only be used for lawful purposes. You agree to comply with all applicable laws, rules, and regulations in connection with your use of the Services. Blueberry Hosting reserves the right to refuse service to anyone.
You are responsible for the activities of your agents, representatives, and end-users ("Users"). The Services shall be used solely for legitimate business and commercial purposes. You shall not use the Services for activities that may be illegal, offensive, abusive, or in a manner that interferes with or adversely affects the Services.
Registrant Benefits & Responsibilities and Prohibited Uses are outlined in accordance with ICANN policies.
Use of the Services to infringe upon another party’s intellectual property rights is prohibited. This includes unauthorized copying or distribution of copyrighted material. Blueberry Hosting follows the Digital Millennium Copyright Act (DMCA) notice and takedown procedures.
You may not use a shared hosting account as a backup/storage device, except for one cPanel backup of the same account.
Zero Tolerance Adult Content Policy: Blueberry Hosting has a zero-tolerance policy for adult content. Prohibited material includes topsites, content related to Cannabis, CBD, IRC scripts/bots, proxy scripts/anonymizers, and more.
Excessive resource usage, including but not limited to CGI scripts, stand-alone server-side processes, web spiders, bit torrent applications, and more, is not allowed. Users must comply with inode limits, and the use of more than 250,000 inodes may result in warnings or suspension.
Blueberry Hosting has a zero-tolerance stance against spam. Sending unsolicited e-mail, bulk emailing, and spam will result in account termination.
Support for WHMCS is limited, and users are directed to contact WHMCS Reseller Support for assistance.
Blueberry Hosting follows Section 230(c) of the Communications Decency Act regarding defamation. Removal of allegedly defamatory material requires a court order.
In addition to the above, the following activities are strictly prohibited:
- Infringement of Intellectual Property Rights.
- Using a shared account as a backup/storage device.
- Hosting adult content.
- Use of more than 25% of system resources for longer than 90 seconds.
- Running unattended server-side processes.
- Running web spiders or indexers.
- Running software that interfaces with an IRC network.
- Running bit torrent applications.
- Participating in file-sharing/peer-to-peer activities.
- Running gaming servers.
- Running cron entries with intervals less than 15 minutes.
- Running MySQL queries longer than 15 seconds.
- Using more than 250,000 inodes on any shared or reseller account.
Blueberry Hosting reserves the right to investigate, cooperate with legal authorities, and implement technical mechanisms to prevent AUP violations. Blueberry Hosting may terminate Services upon any violation of this AUP.
Blueberry Hosting disclaims responsibility for User misuse of Services and any third-party material. Blueberry Hosting is not obligated to monitor User activities unless aware of a violation.
Services may be terminated upon AUP violations. Failure to respond to an abuse department email within forty-eight (48) hours may result in suspension or termination.
